That is the scope that'll go on the 45-70 I think. I have tried to think of a reason to do something else, but this one, with a #4 always comes back to the top.

The best scope that I have had mounted on a .45-70 was a 2.5-8x32 Conquest. The scope mounted low over the bore and was plenty wide enough field for woods hunting and had sufficient eye relief (>4 inches) for the caliber. I had a 2-8x32 Nikon Monarch and the eye relief was too short, whacking my nose with the scope cover lever every shot.

Maybe I'll hold on to my 2.5-8x conquest for when I get a .45-70. I was going to put it on my 7-08, but it didn't fit (strangely, a 3-9x40 Conquest did).

The 2.5-8x32 is kind of short barrel for mounting and barely fit my Mauser action. It fits the Marlin better.

I had a problem with the ocular housing hitting the rear scope mount, which is why it seems odd that the 3-9x40 would fit. I had assumed (I know, I know) that the oculars would be the same.

I bought both a 2.5-8x32 and the ever-popular 1.8-5.5x38 Conquest when I saw them on close-out a few years ago. The 1.8-5.5 was a great partner to the CZ FS in 9.3x62 I originally put it on. It now lives atop my M77/.338 Fed, after selling the CZ. The 2.5-8x32 is biding time mounted on an old Belgian BAR GRII while I make up my mind as to what my final Whelen is gonna be :? It will live on top of that rifle, eventually. I wish now, I'd bought at least two of each as they are very useful power ranges for much of my hunting.

Those would be two scopes I would like to have! That 1.8x5.5 would be a sweet heart on the 45-70/444 Marlin

Naaaaaaa, you wouldn't, as it's WAY big!! That's why Ed always goes back to Leupy for his lever guns; light and hold together. Perhaps not the best & brightest, but they fit the guns. I'm kinda dunb like that.

I had a 2.5-8x32 Conquest on my .45-70. It worked fine compared to the Nikon which I had on there before and which had short eye relief, way shorter than specs (<3 inches).
